CUSTOM HAND-PAINTED DISHWARE
TERMS & CONDITIONS
The following Terms and Conditions are entered into between You and SET APART LLC ("Company", "we", or "us") regarding the purchase of custom hand-painted dishware through www.setapartcompany.com.
By placing an order for custom hand-painted dishware, you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not place an order.
1.0 PRODUCT DESCRIPTION & CUSTOMIZATION
1.1 Hand-Painted Nature: All dishware is individually hand-painted by artisans. Each piece is unique and will have natural variations in color, brush strokes, and artistic details. These variations are inherent to the hand-crafted process and are not considered defects.
1.2 Custom Orders: Custom designs, colors, or personalization requests are subject to our artistic interpretation and feasibility. We reserve the right to modify designs to ensure structural integrity and food safety of the finished product.
1.3 Design Approval: For custom orders, we will provide a design mockup or description for your approval before beginning production. Changes requested after approval may incur additional fees and production delays.
2.0 FOOD SAFETY & CARE
2.1 Food-Safe Materials: All paints and glazes used are food-safe and non-toxic when properly cured and finished according to our standards.
2.2 Care Instructions: Hand-painted dishware requires special care. Detailed care instructions will be provided with each order. Failure to follow care instructions may affect the longevity of the painted design and will void any refund or defect claims.
2.3 Microwave, Oven & Dishwasher Use: Unless specifically noted, hand-painted items should be hand-washed only. Microwave and oven safety varies by design and will be specified with each order.
3.0 ORDERING & PRODUCTION
3.1 Order Timeline: Custom hand-painted dishware requires 3-4 weeks for production from the date of design approval and full payment. Rush orders may be available for an additional fee, subject to our current production schedule.
3.2 Production Schedule: Orders are processed in the sequence received. During peak seasons, production times may be extended, and customers will be notified of any delays.
3.3 Order Modifications: Changes to approved orders may not be possible once production has begun. If modifications are feasible, additional fees and timeline extensions may apply.
4.0 PRICING & PAYMENT
4.1 Custom Pricing: Pricing for custom work is provided via quote and may vary based on complexity, size, quantity, and design requirements.
4.2 Payment Terms: A 30% deposit is required before production begins for all custom orders. Payment plans may be available for orders over $500 and must be arranged in advance.
4.3 Additional Fees: Rush orders, design revisions after approval, and complex custom work may incur additional fees, which will be communicated before work proceeds.
5.0 SHIPPING & DELIVERY
5.1 Shipping Responsibility: Customer is responsible for all shipping costs unless otherwise specified. We will package items with appropriate protective materials, but cannot guarantee against damage during transit.
5.2 Damage Claims: Any shipping damage must be reported within 48 hours of delivery with photographic evidence. We will work with shipping carriers to resolve damage claims and provide replacements or refunds when possible.
5.3 Delivery Delays: We are not responsible for shipping delays caused by carriers, weather, or other circumstances beyond our control.
6.0 RETURNS & EXCHANGES
6.1 Custom Work Policy: Due to the custom nature of hand-painted dishware, NO RETURNS, EXCHANGES, OR REFUNDS are available unless the item arrives damaged of which the shipping carrier may be pursued first for reimbursement.
6.2 Quality Issues: If you receive an item with a manufacturing defect or that significantly differs from your approved design, please contact us within 7 days of delivery. We will evaluate each case individually and may offer a replacement or credit at our discretion.
6.3 Color Variations: Minor color variations from digital mockups are expected due to screen differences and the hand-painted nature of the work and are not grounds for return.
7.0 INTELLECTUAL PROPERTY
7.1 Original Designs: Custom designs created by our artists remain the intellectual property of SET APART LLC unless otherwise agreed in writing. Base products such as; ceramics and glassware are sourced from other providers.
7.2 Customer-Provided Designs: If you provide artwork or designs, you warrant that you have the right to use such materials and grant us permission to reproduce them on your dishware.
7.3 Photography Rights: We reserve the right to photograph completed custom work for our portfolio, marketing, and social media use unless you specifically request otherwise.
8.0 Buyer-Seller Relationship: The relationship created by this agreement is solely a buyer-seller relationship and the parties are independent contractors of each other. This agreement does not make either party the employee, agent, or legal representative of the other for any purpose whatsoever.
9.0 LIMITATION OF LIABILITY
8.1 Warranty Disclaimer: EXCEPT AS EXPRESSLY STATED HEREIN, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE DISHWARE, INCLUDING WARRANTIES OF MERCHANT ABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
8.2 Liability Limits: OUR LIABILITY SHALL NOT EXCEED THE PURCHASE PRICE OF THE SPECIFIC ITEM(S) IN QUESTION. WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.
8.3 Use at Own Risk: While we use food-safe materials and processes, customers use hand-painted dishware at their own risk and discretion.
10.0 Governing Law; Dispute Resolution: This agreement shall be governed by Connecticut law. Any dispute arising from this agreement shall first be addressed by the parties through informal dispute resolution procedures conducted in good faith. If the parties do not resolve the dispute within thirty days of the date of the first dispute resolution meeting, the parties agree to mediate the dispute in a mutually agreed-upon place with a mutually agreed-upon mediator, the costs of which shall be borne equally by the Parties. In the event the dispute is not resolved through mediation, the dispute shall be settled by binding arbitration before a single arbitrator in Middletown, in accordance of the rules of the American Arbitration Association. The Parties agree that judgment upon the award rendered by the arbitrator shall be entered in a court of competent jurisdiction where you would want to receive judgement/damages in Middletown.
11.0 MISCELLANEOUS
10.1 Entire Agreement: These terms, along with your order confirmation and design approval, constitute the entire agreement regarding your custom dishware purchase.
10.2 Modification: We reserve the right to modify these terms at any time. Current terms will be posted on our website and apply to all orders placed after the effective date.
10.3 Severability: If any provision of these terms is found invalid, the remainder shall remain in full force and effect.
10.4 Governing Law: These terms are governed by Connecticut law.
